Le Bain Hostess Sues Patron: A hostess at the Meatpacking District hotspot Le Bain suffered an attack from a crazed patron who kicked her multiple times, she alleges in a new lawsuit.
“…savagely grabbed her and kneed and kicked her in the vagina multiple times…”
Rachel Mosley — who is 4-feet-11 and 105 pounds — was “working hard and minding her own business” around 1:30 a.m. Oct. 15 at the nightclub, located in the Standard Hotel over the High Line on Washington and W. 13th Sts., she said.
That’s when a boozed-up Benjamin Brittain “savagely grabbed her and kneed and kicked her in the vagina multiple times, causing her severe and significant injury,” according to her Manhattan Supreme Court lawsuit.
“It was extremely horrible,” the 27-year-old told the Daily News on Monday. “I felt like I was living in a nightmare. He just attacked me for no reason.”
Mosley said she managed to escape from Brittain, who at 6-feet-6 towered over. She told security what allegedly had happened.
Bouncers then tossed Brittain out of Le Bain — and police officers collared him shortly thereafter, NYPD records show.
Brittain, 25, ultimately pleaded guilty to disorderly conduct on Feb. 22.
A Manhattan judge later sentenced Brittain to four days of community service and issued an order of protection against him.
The lawyer representing Brittain in the criminal case declined to comment on his client’s behalf Monday, and declined to put The News in contact with Brittain or his civil attorney.
“paralyzing nightmares and flashbacks…”
Mosley, 27, said she is going to physical therapy three times a week for severe pelvic and back pain.
She also claims to suffer “paralyzing nightmares and flashbacks,” as well as posttraumatic stress disorder, from the incident.
Mosley is seeking unspecified damages from Brittain. The Standard Hotel is not named as a defendant in the lawsuit.
“This is a serious case — and this is the first step for Ms. Mosley to get justice,” said her lawyer Jordan Merson.
